Terms of Service

1. General
These Terms of Service ("Terms") govern your use of the Kube-DC platform, website (kube-dc.com), documentation, and related services (collectively, the "Service") provided by DESFECHO RELEVANTE UNIPESSOAL LDA ("Company", "we", "us"), registered in Portugal. By accessing or using the Service, you agree to be bound by these Terms.
2. Description of Service
Kube-DC is a Kubernetes-native cloud platform that enables organizations to deploy and manage virtual machines, Kubernetes clusters, databases, storage, networking, and related infrastructure services on their own bare-metal servers. The Service is provided as downloadable software licensed on a per-socket basis.
3. Account and Access
To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.
4. License and Usage
Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to use the Kube-DC software in accordance with the selected subscription plan. You may not:
- Reverse engineer, decompile, or disassemble the software
- Sublicense, resell, or redistribute the software without a separate agreement
- Use the software to provide competing cloud platform services without a Cloud Provider agreement
- Remove or alter any proprietary notices or labels
5. Pricing and Payment
Fees are based on the subscription plan selected and are billed per CPU socket. Prices are listed on our Pricing page and are subject to change with 30 days' notice. All fees are exclusive of applicable taxes (VAT). Payment is due within 14 days of invoice date unless otherwise agreed. Late payments may incur interest at the statutory rate.
6. Free Tier
We offer a free tier limited to 4 CPU sockets with community support. The free tier is provided "as is" without SLA guarantees. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
7. Support and SLA
Support levels depend on your subscription plan. Standard and Premium plans include email and ticket-based support with defined response times. Service Level Agreements (SLAs) are available for Premium plans and are detailed in a separate SLA document. The free tier includes community support only.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Kube-DC is deployed on your own infrastructure — we do not host or have access to your workloads, virtual machines, or tenant data. Telemetry data, if enabled, is limited to platform health metrics and does not include personal or workload data.
9. Intellectual Property
All intellectual property rights in the Service, including software, documentation, trademarks, and design, remain with the Company. These Terms do not grant you any rights to our intellectual property except the limited license described in Section 4.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim.
11. Termination
Either party may terminate these Terms with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your license to use the software ceases. Sections relating to intellectual property, limitation of liability, and governing law survive termination.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Faro, Portugal.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
